1. Acceptance of Terms

By downloading, accessing, or using GutCheck ("App," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

The App is a consumer wellness tool intended for general information and inspiration only
Nothing in the App is medical advice, nutritional therapy, or professional health advice
The App is not a substitute for consultation with a doctor, registered dietitian, or other qualified healthcare professional
You must not rely on the App to diagnose, treat, cure, or prevent any disease, allergy, or medical condition
Always consult a qualified healthcare provider before making dietary changes, especially if you have a medical condition such as IBS, GERD, or LPR

2. AI-Generated Content

The App uses artificial intelligence (powered by OpenAI) to generate food analysis, recommendations, and related content. You acknowledge that:

AI-generated content may be inaccurate, incomplete, or contain errors
AI may produce "hallucinations" (plausible but false information)
AI is not a healthcare professional and cannot assess your individual health needs
Food image recognition may misidentify ingredients or miss important details
AI-generated recommendations are based on general guidelines, not your specific medical history or laboratory results
Always verify AI-generated content before use

3. Food Allergies and Safety

You are solely responsible for:

Checking all ingredient labels before consuming food
Verifying allergen information with manufacturers
Avoiding foods that may trigger allergic reactions
Following proper food safety practices
Consulting your healthcare provider about food allergies and intolerances

We do not guarantee that our AI can detect all allergens, contaminants, or harmful substances. Image recognition is a convenience feature only and should not be relied upon for food safety or allergen detection.

4. User Accounts

To use certain features of the App, you must create an account using Sign in with Apple. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

5. Subscription and Payments

The App offers both free and paid subscription plans. All purchases are processed through Apple's App Store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your Apple ID account settings.

6. User Content

You retain ownership of any content you submit to the App (food photos, text descriptions). By submitting content, you grant us a license to use it solely for the purpose of providing and improving the App's services.

7. Prohibited Conduct

You agree not to:

Use the App for any illegal purpose
Attempt to gain unauthorized access to any part of the App
Interfere with or disrupt the App or its servers
Use the App to provide medical advice to others
Submit false or misleading health information
Use automated means to access the App without our permission

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

Health-related decisions made based on App recommendations
AI-generated content errors or inaccuracies
Food allergen misidentification
Direct, indirect, incidental, special, or consequential damages
Loss of data, profits, or business opportunities

YOU USE THE APP AT YOUR OWN RISK.

9. Indemnification

You agree to indemnify and hold harmless GutCheck and its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including attorneys' fees) arising from your use of the App or violation of these Terms.

⚠️ NO EMERGENCY USE

This App is not designed for emergency medical situations. If you are experiencing a medical emergency, call 911 (or your local emergency number) immediately.

10. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for any reason, including violation of these Terms. Upon termination, your right to use the App will immediately cease.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in San Francisco, California.
